Bais City Violates Water Code
Violating Article 3 of the Water Code of the Philippines or the Presidential Decree 1067, Bais city government was ordered to cease and desist their operation of utilizing the Mabunao Tina-an Water Source.
The decree states that that no person, including government instrumentalities or government owned or controlled corporation, shall appropriate water without water right, which shall be evidenced by a document known as a water permit.
The city government of Bais has been distributing potable water to indigent residents of the city especially those who are living in the coasts.
Bais City Water District then passed a resolution to the National Water Resources Board to give a cease and desist order to the city government for its alleged inappropriate use of the water source.
It is for the reason that the city government of Bais failed to get a permit from the NWRB which also took action of the complaint and sent a Cease and Desist Order to the city of Bais which is headed by Mayor Hector Villanueva.
The order was signed by Executive Director of NWRB Ramon Alikpala.
The order was sent to Bais City Water District and states that the order should take effect after 15 days after the receipt of the letter.
It further states that failure to execute the order may lead to NWRB’s action to file appropriate administrative and criminal charges against the city government.
