Court orders return of Search Warrant
The court ordered the Provincial Police Office to return the search warrant and the confiscated materials, during their operation, to the Municipal Trial Court.
The order was declared yesterday by Judge Antonio Estoconing to SPO2 Rustam Grefalde who filed for the search warrant.
According to Estoconing, under section 12, rule 126 o the Revised Rules of Court, it is essential that the search warrant and the confiscated materials during the operation be returned and turned over to the judge of court right away.
Judge Estoconing earlier issued the search warrant number 2007-01 last November 23 against Paul Bana, Florecita Bana, Paul Bana Jr., Julie Melon, Randy Cataylo, Romeo Cataylo and other staff of the illegal numbers game “suertres” operation.
The raid was done at Bana’s rented house at Purok Makiangayon, Barangay Calindagan.
In the search warrant issued by Judge Estoconing, it was stated that the search warrant must be returned within ten days after its issuance.
